Terms of Service for the Electronic Provision of Services

In force as of 22 May 2026.

§ 1. General provisions

  1. These Terms of Service set out the rules for providing services by electronic means within the SendItNow service, available at https://senditnow.online (hereinafter: the "Service").
  2. The Service Provider is Łukasz Wicenciak, a sole proprietor with its registered office at ul. Sarnia 2/84, 61-058 Poznań, Poland, Tax ID (NIP): 7822386443, REGON: 302410980 (hereinafter: the "Service Provider"). Warehouse (fulfilment centre) address: ul. Jasińska 13, 62-020 Swarzędz, Poland.

  4. These Terms of Service are made available free of charge at https://senditnow.online/regulamin in a manner that allows them to be obtained, reproduced and stored.
  5. These Terms of Service constitute the terms referred to in Article 8 of the Polish Act of 18 July 2002 on the Provision of Services by Electronic Means (Journal of Laws of 2020, item 344, as amended).

§ 2. Definitions

  1. Service — the SendItNow IT system made available by the Service Provider at https://senditnow.online, used to manage offers, orders and inventory levels across multiple online sales channels.
  2. User — an entrepreneur within the meaning of Article 43¹ of the Polish Civil Code, using the Service in connection with their business or professional activity.
  3. Account — a separate, individual part of the Service secured with a login and password, through which the User uses the Service.
  4. Services — services provided by the Service Provider by electronic means in accordance with these Terms of Service, including SaaS services and additional services.
  5. Plan / Subscription — the billing model chosen by the User, defining the scope of available features and the billing period.
  6. Wallet — a balance maintained for the User within the Service, used for internal settlements (e.g. fees for additional services, reservations against order fulfilment), funded by the User through top-ups.
  7. Payment Operator — an entity providing payment services enabling payments within the Service, in particular PayNow (mElements S.A.) and Stripe.

§ 3. Type and scope of services

  1. The Service Provider provides the following Services within the Service:
    • provision of a SaaS panel for managing offers, orders and inventory across multiple sales channels (including Allegro, Shopify, eBay, Empik, Kinguin, G2A, Eneba);
    • integrations with external sales platforms via their official APIs;
    • analytics tools, reports and automations within the panel;
    • management of the User's Wallet and settlement of fees for additional Services;
    • additional services offered within the Service for a fee according to the current price list.
  2. The detailed scope of features available under each Plan is presented within the Service before the contract is concluded.
  3. Use of some Services may require accepting the terms and conditions of third parties (marketplace operators, Payment Operators). The Service Provider is not liable for the content of those terms or for any changes to them.

§ 4. Technical conditions for using the Service

  1. Proper use of the Service requires:
    • a device with access to the Internet;
    • an up-to-date web browser supporting HTML5, CSS3, JavaScript and cookies (recommended: Chrome, Firefox, Safari, Edge in current versions);
    • an active e-mail account;
    • for selected integrations — access credentials for accounts on third-party platforms.
  2. The Service Provider is not liable for disruptions in the use of the Service resulting from causes attributable to the User or to third parties (including Internet providers, sales platform operators, Payment Operators).

§ 5. Conclusion of the contract and Account registration

  1. The contract for the provision of Services is concluded upon creation of an Account or — in the case of services that do not require registration — upon commencement of use of the relevant Service.
  2. Account registration requires providing data identifying the User as an entrepreneur (including company name, Tax ID (NIP), address, e-mail address), setting a password, and accepting these Terms of Service and the Privacy Policy.
  3. The User declares that they use the Service solely for purposes related to their business activity and are not a consumer within the meaning of Article 22¹ of the Polish Civil Code.
  4. The User is obliged to provide data that is true, current and accurate, and to update it without undue delay.
  5. The User is responsible for maintaining the confidentiality of the Account access credentials and for all actions performed through the Account.

§ 6. Fees and payments

  1. Use of selected Services is subject to fees according to the current price list presented within the Service. Prices are stated in Polish zloty (PLN) and are net prices, to which VAT at the applicable rate is added, unless expressly stated otherwise.
  2. Payments within the Service may be made via:
    • PayNow — operator: mElements S.A. with its registered office in Warsaw, ul. Prosta 18, 00-850 Warsaw;
    • Stripe — operator: Stripe Payments Europe, Ltd.
  3. Available payment methods include, in particular, BLIK, electronic transfers (Pay-by-link), payment cards and other methods made available by the Payment Operators.
  4. Wallet top-ups are credited to the User's balance without undue delay after the Service Provider receives confirmation from the Payment Operator that the transaction succeeded. Funds in the Wallet are used solely for settlements within the Service and are not subject to cash withdrawal, subject to § 8.
  5. Subscriptions are billed in advance, in the billing cycles specified in the selected Plan. Failure to pay on time may result in suspension of access to paid Services.
  6. A VAT invoice is issued within the time limit compliant with applicable regulations and made available to the User in electronic form. The User consents to invoices being issued and delivered in electronic form.

§ 7. Complaints

  1. Complaints regarding the Services may be submitted:
    • by e-mail to kontakt@senditnow.online;
    • in writing to the Service Provider's registered office.
  2. A complaint should include data identifying the User, a description of the subject of the complaint and the expected manner of its resolution.
  3. The Service Provider examines a complaint within 14 days of its receipt and informs the User of the manner of its resolution by electronic means.
  4. Complaints concerning the course of a payment transaction should be addressed directly to the relevant Payment Operator, in accordance with its terms and conditions.

§ 8. Refunds and termination

  1. Given that the User of the Service is exclusively an entrepreneur, the right of withdrawal from a distance contract available to consumers (Article 27 et seq. of the Polish Consumer Rights Act) does not apply.
  2. The User may at any time cease further use of the Service by deleting the Account. Termination does not give rise to an obligation to refund fees paid for a billing period that has already begun, unless mandatory provisions of law provide otherwise.
  3. Unused funds accumulated in the Wallet may be refunded to the User upon their request submitted to kontakt@senditnow.online, after deduction of the refund costs charged by the Payment Operator and after settlement of all amounts owed by the User to the Service Provider.

§ 9. Liability

  1. The Service Provider exercises due diligence to ensure that the Service operates continuously and correctly. The Service Provider reserves the right to technical breaks necessary for maintenance, updates or development of the Service.
  2. The Service Provider is not liable for:
    • interruptions in the operation of the Service resulting from causes beyond the Service Provider's control, in particular failures of third-party infrastructure, force majeure, and changes to the APIs of sales platforms and Payment Operators;
    • damage arising from improper use of the Service by the User or by persons to whom the User has disclosed the Account access credentials;
    • the content of offers, product descriptions and other data entered into the Service by the User.
  3. Given the professional nature of the User, the Service Provider's liability towards the User for improper performance of the Services is limited to the amount of fees paid by the User for the given Service in the 3 months preceding the event giving rise to liability. This limitation does not apply to damage caused intentionally.

§ 10. User obligations

  1. The User is obliged to use the Service in accordance with its intended purpose, applicable law, these Terms of Service and the principles of social conduct.
  2. It is prohibited to supply to the Service any content of an unlawful nature, including content infringing the rights of third parties, copyrights, personal rights, as well as misleading content or content contrary to good practice.
  3. It is prohibited to take actions that may hinder or destabilise the functioning of the Service, including attempts to gain unauthorised access to the Service, to other Users' data or to the Service Provider's infrastructure.

§ 11. Personal data

  1. The controller of Users' personal data is the Service Provider.
  2. The detailed rules for processing personal data, including information on the purposes of processing, legal bases, data recipients and the rights of data subjects, are set out in the Privacy Policy available within the Service.
  3. To the extent that the User entrusts the Service Provider with the processing of personal data of third parties (e.g. their customers or contractors), the parties conclude a data processing agreement, the content of which forms an annex to these Terms of Service or is made available to the User on request.

§ 12. Changes to the Terms of Service

  1. The Service Provider reserves the right to amend these Terms of Service, in particular for important reasons such as changes in law, changes to the scope or manner of providing the Services, or technical or security considerations.
  2. Users will be informed of any change to the Terms of Service by electronic means — at the e-mail address assigned to the Account or via a notice within the Service — at least 14 days before the changes take effect.
  3. Failure by the User to accept changes to the Terms of Service entitles the User to terminate the contract with immediate effect, no later than the day the changes take effect.

§ 13. Final provisions

  1. In matters not regulated by these Terms of Service, Polish law applies, in particular the Civil Code, the Act on the Provision of Services by Electronic Means and the GDPR.
  2. Any disputes arising from a contract concluded under these Terms of Service will be resolved by the court having jurisdiction over the Service Provider's registered office.
  3. If any provision of these Terms of Service proves to be invalid or ineffective, this does not affect the validity and effectiveness of the remaining provisions.
  4. These Terms of Service are in force as of 22 May 2026.
